Each year, billions of dollars are lost to fraud.
We all ultimately pay for fraud, through higher premiums that are necessary to cover claim costs that have been illegally inflated from fraudulent claims submitted to the insurance companies.
The Health Insurance Portability and Accountability Act of 1996 (HIPAA) makes health care fraud a federal crime. Health care fraud occurs when anyone knowingly and willfully attempts to defraud any health care benefit program in connection with the delivery or payment of health care benefits.
A person who violates the statute may be fined, imprisoned up to 10 years, or both. The penalties are much more severe if the patient is injured or dies as a result of the fraud.
HIPAA also prohibits knowingly and willfully falsifying, concealing, or covering up a material fact; or making a false statement; A person who commits this type of fraud may be fined, imprisoned up to five years, or both.
At American Medical and Life Insurance Company, we want to pay every medical claim that we are obligated to pay under our contract with our policyholders; however, we do not want to pay any claims that are based on lies and deceit.
